POPIA Data Correction or Deletion of Information
B1 LINK DATA CORRECTION OR DELETION PROCESS
The B1 LINK platform complies with the requirements of the Protection of Personal Information Act, 4 of 2013 in relation to the collation, use of, correction and destruction of any Personal Information recorded within the Platform. To this end, B1 LINK has implemented the following process to ensure that all requests for data correction and deletion are processed in accordance with the requirements of the Act.

Rights and Obligations of the Data Subject
- A "Data Subject" means the person to whom personal information relates.
- Any Data Subject or Responsible Party requesting correction to, or deletion of a Record, must do so by means of the B1 LINK Request for Deletion or Correction form.
- The Data Subject must provide means of Identification which can be compared to that contained within the Data Subject’s profile.
- The signed Request for Deletion form, with proof of identity, must be emailed to B1 LINK at support@b1sa.co.za AND must clearly include the word POPIA in the subject line of the email.
- A request for correction or deletion of personal information may only be made in instances where the personal information held is inaccurate, irrelevant, excessive, out of date, incomplete, misleading or obtained unlawfully.
- A request for destruction or deletion of a record of personal information may only be made in instances where the responsible party is no longer authorised to retain same in terms of section 14 of POPIA.
Rights and Obligations of the Operator or Responsible Party
- An "Operator" means a person who processes Personal Information for a Responsible Party in terms of a contract or mandate, without coming under the direct authority of that party.
- A "Responsible Party" means a public or private body or any other person which alone or in conjunction with others, determines the purpose of and means for processing personal information.
- B1 LINK is obligated to comply with a Data Subject’s request to erase Personal Data from the Platform, subject to the Data Subject request being in compliance with the requirements of the Act.
- Upon request from the Data Subject for deletion of Personal Information, B1 LINK will determine whether it acts, in relation to the applicable Data Subject Record as an
- Operator, being the appointed agent of a Responsible Party (a client to B1SA), who has contracted B1SA for the specific purposes of collating data on behalf of their Data Subjects (suppliers), or as a
- Responsible Party, where the Data Subject has directly contracted with B1 LINK for the purposes of collating their own data.
- Where B1 LINK determines itself to be an Operator, in the context of a specific request from a Data Subject, B1 LINK is prohibited, by law, to act on the Data Subjects request.
- B1 LINK will instead refer the Data Subject to the relevant Responsible Party for whom B1SA provides the data services related to the specific Data Subject, and said Responsible Party will then be required to formally instruct B1SA to action the deletion of the Data Subject record.
- If the request relates to a correction or deletion of personal information, B1 LINK will determine whether the request is regular on the basis that the relevant personal information is inaccurate, irrelevant, excessive, out of date, incomplete, misleading or obtained unlawfully, or
- If the request relates to a destruction or deletion of a record of personal information, B1 LINK will determine whether the request is regular on the basis that B1 LINK is no longer authorised to retain same in terms of section 14 of the Act.
- If the aforementioned does not apply, B1 LINK will inform the data subject accordingly.
- If the aforementioned does apply, B1 LINK will determine whether any of the provisions of 14(1), (2) or (3) exempt B1 LINK from, or otherwise prohibit B1 LINK from, correcting, deleting or destroying the record.
- If nothing exempts or prohibits B1 LINK from correcting, deleting or destroying the record, B1 LINK will act accordingly and advise the data subject.
- If something exempts or prohibits B1 LINK from correcting, deleting or destroying the record, B1 LINK will act accordingly and advise the data subject.
- Upon deletion of the Data Subject record, B1 LINK will confirm that the data has been actioned in accordance with the Data Subject or Responsible Party’s request, and in accordance with the requirements of the Act.
